BULLYING REPORT PROCEDURES

Bullying by definition:  Texas Education Code 37.0832

Bullying means engaging in written or verbal expression, expression through electronic means, or physical conduct that occurs on school property, at a school-sponsored or school related activity, or in a vehicle operated by the district that (1) has the effect or will have the effect of physically harming a student, damaging a student's property, or placing a student in reasonable fear of harm to the student's person or property, or (2) is sufficiently severe, persistent, and pervasive enough that the action or threat creates an intimidating, threatening, or abusive educational environment for a student.  Bullying exploits an imbalance of power between the student perpetrator and the student victim through written, verbal, or electronic expression or physical conduct.  It is bullying if it interferes with a student's education or substantially disrupts the operation of a school.

WHO CAN MAKE A REPORT?

Any school official, teacher, staff member, or student can make a bullying report.  Parents and community members can also report.

HOW DO I MAKE A REPORT?

Anna Middle School has set up a report form on the AMS portion of the Anna ISD website.  All reports are to be made using this online form.  This form will come directly to the middle school counselor. This will be the procedure for making a bullying report unless the reporter feels as though it is a life threatening emergency.  In this case, the reporter needs to go directly to the counselor in person to make the report.

WHAT WILL OCCUR AFTER I MAKE A REPORT?

If this is the first report, the middle school counselor will conduct an investigation that will involve visiting with both the bullied and the bully, visiting with any witnesses, and making contact with a parent/guardian of the bullied/bully.  A warning will be given to the bully, or the counselor will pass it on to an administrator if the action calls for increased discipline.

If this is the second report involving the same bully, the counselor will give it directly to the assigned administrator.  Consequences will be based on the offense and could include detention, suspension, DAEP placement, or any other punishment deemed appropriate by the Anna ISD Student Code of Conduct.

If this is the third report involving the same bully, the counselor will give it directly to the assigned administrator and the Student Resource Officer.  Consequences will be based on the offense and could include the issuance of a criminal ticket and/or an arrest of the perpetrator by the SRO.

*Any report involving electronic devices or social media will be given by the counselor directly to an administrator.

THREE IMPORTANT THINGS TO REMEMBER WHEN REPORTING A BULLYING INCIDENT:

  • 1. Bullying cases that most often lead to litigation involve victims who are members of a protected class: gender, sexual orientation, race, nationality, disability, and/or religion.
  • 2. Many forms of bullying are now punishable by law. Ignoring an incident is not an option! Err on the side of caution. It is better to report something than not if you think bullying has occurred or is occurring.
  • 3. Bullying is behavior that is often, but not always, repeated, intentional, and has an imbalance of power.
